Our Chapter 7 Bankruptcy Practice
In a Chapter 7 bankruptcy filing, you are allowed to permanently discharge certain debts (student loans, child support arrearages, and some taxes may be excluded) in exchange for the sale of nonexempt assets. Immediately upon filing your petition for bankruptcy, an automatic stay goes into effect, prohibiting your creditors from contacting you or taking any legal action against you to collect the debt (other than through the bankruptcy proceeding).
Under the recent revisions to the bankruptcy laws, you must qualify to discharge your debts through a means test. You will only be allowed to seek protection under Chapter 7 if the bankruptcy court determines that you lack the “means” to repay your creditors in full over a three- to five-year period.
