Our Chapter 13 Practice

Under the recent revisions to the bankruptcy laws, you must qualify to discharge your debts under Chapter 7 through a means test. If you do not qualify for Chapter 7, we will review your income potential and your obligations to determine whether you can pay your creditors in full over a three- to five-year period by negotiating new terms. If so, your only recourse in bankruptcy will be under Chapter 13. Regardless of whether you file for Chapter 7 or Chapter 13, an automatic stay will go into effect, preventing your creditors from attempting to collect the debt through any means other than the bankruptcy proceeding.

When we represent you in a Chapter 13 filing, we handle all aspects of the bankruptcy. We will prepare and file all the documents necessary to initiate the process and will be your advocate in meetings or other proceedings with creditors, the bankruptcy trustee, or the court.
